1. Services Provided

I offer professional photography services, including but not limited to event photography, portrait sessions, and commercial photography. Detailed descriptions of current services and packages can be found on the Services page.

2. Booking and Payment

• Invoice Deposit: To secure a session date and time, a non-refundable invoice deposit is required. Payment in full is required for same day bookings. No booking is officially confirmed until this deposit is received.

• Contract Requirement: For all photography projects and creative packages exceeding $400, a signed formal contract is required alongside the invoice deposit to fully secure the booking.

• Remaining Balance: The final remaining balance is due in full within 48hrs of your scheduled session.

• Accepted Payment Methods: Payments can be made via Zelle, PayPal, Cash App, Cash, and/or Credit/Debit cards.

3. Cancellation and Rescheduling

• Notice Period: Clients may request to reschedule their session by providing at least 24 hours' notice prior to the scheduled time. While rescheduling is always preferred, requests are subject to my availability.

• Forfeiture: Cancellations or failure to provide a 24-hour notice will result in the immediate forfeiture of the invoice deposit and your scheduled time slot.

4. Copyright and Usage Rights

• Ownership: All images captured by Kahleag Terry are protected under federal copyright law and remain my exclusive intellectual property.

• Personal Use License: Clients are granted a non-exclusive, perpetual license for personal use of the delivered images (e.g., printing, personal social media sharing).

• Commercial Use: Any commercial use, resale, or third-party distribution of the images requires prior written permission and may incur additional licensing fees.

5. Client Responsibilities & Permissions

Clients are entirely responsible for securing all necessary permissions, permits, location passes, and clearances required for the subjects and venues being photographed. I am not liable for any delays, interruptions, or cancellations arising from a lack of proper permissions or location access.

6. Assumption of Risk & Liability Waiver

Photography sessions may take place in a variety of environments, including but not limited to rugged outdoor landscapes (such as bluffs, shorelines, and ravines) or indoor studio spaces.

• Voluntary Assumption: By booking or participating in a session, you voluntarily assume all inherent risks associated with these environments, including slips, trips, falls, or weather-related incidents.

• Release of Liability: You hereby release and hold harmless Kahleag Terry from any and all liability, claims, or demands for personal injury, property damage, or financial loss that may occur during the course of the project.

7. Model Release & Promotional Use*

*The following applies to Modeling Inquiries Only

By participating in a session or submitting an application, you grant Kahleag Terry the irrevocable right to use the photographs and video captured during the sessions for portfolio display, website content, social media, self-promotion, and speculative brand advertisements ("Spec Work").

• Creative Freedom: You acknowledge that these images may be edited, cropped, or combined with other media at my creative discretion.

• Waiver: You waive the right to inspect or approve the finished product and acknowledge that these images may be used to market my professional skills to third-party brands and agencies.

8. Trade for Print (TFP) Addendum*

The following terms apply strictly to non-monetary, collaborative portfolio projects:

• Compensation: TFP sessions are non-monetary collaborations. In exchange for modeling services, the model will receive up to 10 high-resolution edited digital images and three (3) 3D "Wiggle-gram" assets for personal portfolio use. No monetary compensation will be provided.

• Attribution: Any social media postings of these images by the model must include proper, visible credit to the Photographer.

• Age Requirement: By entering into a TFP agreement, you verify that you are 18 years of age or older and possess the full legal right to sign this agreement.
